The Division of Marital Property in Utah

While many divorcing Utah couples hope that the process will unfold amicably, matters can sometimes become contentious. Positions can often become entrenched when the matter of child custody or visitation is addressed, and some couples find it difficult to agree on how marital property will be divided. If you are considering a divorce, it may be wise to understand how Utah law treats assets that were acquired before and during a marriage.

Assets you have acquired during your marriage are considered marital property, and Utah law requires that they be divided equitably. However, this does not mean that all assets must be divided equally between the spouses. If one spouse were to be awarded the primary residence, the other may receive other assets of comparable value, such as a stock portfolio or art collection, in return. Even the equitable division of property could become a thorny issue if you and your spouse are unable to agree on how much your assets are worth.

Assets that you owned prior to getting married, or an inheritance you received while you were married, are considered separate property, and they will generally not be divided with your spouse. However, this too can become a delicate subject if the property concerned has been commingled. An example of this could be placing inherited money into a jointly held account. The money may then be considered a gift to the marriage.

Our experienced family law attorneys have encountered these situations, and we are often able to anticipate and address potential areas of conflict. At times, we will call upon appraisers and other financial advisers when spouses are unable to agree on the value of marital property. I have worked closely with Marco Brown and Nathaniel Garrabrandt in many capacities. I refer family, friends, and clients to Brown Family Law because I know they will be taken care of by attorneys that understand the law and know how to effectively advocate for their clients. Highly recommended!
Response from the owner: Aaron, thank you. We appreciate your trust.
I can't say enough good about this group. At the end of the day, Ray Hingson went out of his way to make everything run smooth. Even though the other firm encouraged and allowed them to use character assassination as a tactic, Ray stayed above the fray and made sure things were fair for both parties. If you want integrity and fairness for everyone involved these are your guys.
Response from the owner: Brandon, thank you for the recommendation. Glad Ray was able to help you.
Tarl Johnson was incredible! He was professional, thorough, and explained everything in a way I could easily understand. I left the meeting confident and informed. Highly recommend!!!!
Response from the owner: Thank you for your kind words.
Andrew Christensen was an amazing advocate. He had my best interests in mind, he listened, kept me informed, made time for me, and had all the answers. No detail escaped his notice. He saved me time and money and I felt taken care of. I highly recommend Andrew to anyone.
Response from the owner: Jamie, so glad Andrew was able to help you.
I would absolutely recommend Brown Family Law. In my situation, I paid the consulting fee and met with an attorney. In this meeting, the attorney was very kind and honest. After going through the details of my concerns, he informed me that it was highly likely that taking my concerns to court would cost more than what I'd see back. He also offered to refund the original consulting fee. I felt heard and trusted the advice he provided and decided to not move forward. I felt so much better after just talking with him even though the outcome wasn't what I wanted. At least I know now and am not constantly wondering. Thank you Brown Family Law for giving me peace of mind and for being so trustworthy.
Response from the owner: Mindy, thank you and glad Clay made you feel heard.
Daniel young was absolutely fantastic to work with and I would highly recommend him.
Response from the owner: Jaiden, glad Daniel was able to help you with your case. Thank you for your recommendation.
Great to work with, thanks for everything
Response from the owner: Aaron, glad we could help.
